Where a Middlesex County Truck Case Is Heard

A truck injury lawsuit from a Middlesex County crash is normally filed in the Superior Court, Law Division, at 56 Paterson Street, New Brunswick. Venue is proper where the crash happened, so an out-of-state carrier cannot move it home.

The one real exception is federal court. A carrier based in another state can sometimes remove a case to the U.S. District Court for the District of New Jersey, which could place it in Trenton or Newark. Whether that is possible depends on who is named as a defendant, which is decided at the start of the case.

The venue rule, in the court's own words

New Jersey Court Rule 4:3-2 sets where a civil case belongs. For a negligence case, venue lies "in the county in which the cause of action arose, or in which any party to the action resides at the time of its commencement, or in which the summons was served on a nonresident defendant." A crash in Middlesex County means the cause of action arose here.

A business entity "resides" in the county of its registered office "or in any county in which it is actually doing business." A trucking company that runs loads through the Exit 8A warehouses or the Turnpike every day is doing business in Middlesex.

Claims against a public entity, such as a town truck, NJ Transit or the New Jersey Turnpike Authority, must be brought "in the county in which the cause of action arose." Those claims also carry a 90-day notice requirement; see evidence deadlines.

A local example: lawsuits over the August 9, 2022 Turnpike bus crash in Woodbridge were filed in Middlesex County Superior Court. The most recent was filed on January 24, 2024. Nothing here describes those cases or their outcome; the point is only where they were filed.

Federal court: Trenton or Newark

Which courthouse

The District of New Jersey does not assign counties to a courthouse. The Clerk allocates each case to Camden, Newark or Trenton considering the defendant's residence, the convenience of the parties and witnesses, and where the cause of action arose. A Middlesex crash could land in Trenton or Newark.

When a carrier can remove the case

Federal diversity jurisdiction requires that the plaintiff and every defendant be citizens of different states and that more than $75,000 be in controversy. A corporation is a citizen of its state of incorporation and of its principal place of business.

28 U.S.C. 1332

When it cannot

A case filed in New Jersey state court cannot be removed on diversity grounds if any properly joined and served defendant is a New Jersey citizen. This is the forum-defendant rule.

28 U.S.C. 1441(b)(2)

Why the list of defendants decides the courthouse

Most Middlesex truck crashes involve more than one company: the carrier, the owner of a leased tractor, the broker that booked the load, the warehouse that loaded it. If one of those is a New Jersey company and is properly named and served, the forum-defendant rule keeps the case in state court in New Brunswick. If the only defendant is an out-of-state carrier and the claim exceeds $75,000, the carrier can remove the case to federal court.

That is why identifying every responsible party is not just about recovery. It shapes where the case is heard, which rules of procedure apply and how long it takes. The same work that finds the right insurer also anchors the case in Middlesex County.

One more place to look: if the truck driver was charged, the criminal case is searchable in NJ Courts' Criminal Public Access system. The civil case proceeds separately, and the two files are kept apart until the civil subpoenas reach the prosecutor's records. See who investigates.

What's hard to do alone

  • Joining the right New Jersey defendant, whether a local carrier, broker, lessor or warehouse, decides whether an out-of-state carrier can pull the case into federal court. It has to be done correctly at filing and service.
  • A public-entity defendant changes the venue rule, adds the 90-day notice of claim, and limits the damages that can be recovered.
  • Removal fights have their own deadlines, measured in days from service, and are argued on paper before a federal judge.

“When you hire us as your legal team, we will investigate every aspect of the accident to determine liability and ensure that all responsible parties are held accountable.”
