How Fees Work

You can afford a lawyer while you are out of work. Initial consultations are free, and if we take your case, there's no fee unless we win. The fee is a percentage of the recovery, paid at the end.

New Jersey's Rules of Professional Conduct allow a law firm to describe a contingent fee this way only if the description "would not be misunderstood or deceptive" (RPC 7.1), so this page says what that sentence covers and what it does not.

Three steps

  1. Step 1: You call

A free consultation, by phone, at an office, or at your home or hospital. You do not pay for this conversation whether or not you hire the firm.

We listen, answer your questions and tell you honestly whether we can help.
  2. Step 2: We investigate

The police report, the trucking company's records, the carrier and its insurers, and your own auto policy's injury coverage.

We order the report, send the preservation letters and open the insurance claims. "Let us handle the paperwork and negotiations so you can focus on recovering from your injuries."
  3. Step 3: Fee at the end

The attorney fee is a percentage of the recovery and is paid out of the recovery. If there is no recovery, there is no attorney fee.

We explain the fee agreement in writing before you sign anything.

Fee versus costs

The fee is what the firm is paid for its work. In a contingency case it is a percentage of the money recovered. Costs are the out-of-pocket expenses of building a case: police reports, records requests, traffic-camera video (NJDOT charges $100 per camera for the first three hours), court filing fees and the like.

Whether you owe case costs when there is no recovery is spelled out in writing in the fee agreement before you sign it, and you can ask about it on the first call.

Who pays the medical bills first

If you were in a car when the truck hit you, your own auto policy pays your medical bills first through personal injury protection (PIP), up to $250,000 per person per accident on a standard New Jersey policy (N.J.S.A. 39:6A-4). This is true even when the crash was not your fault. The truck's liability insurer comes later.

Coordinating PIP, health insurance and the truck's insurer is paperwork most people have never done, and each payer has its own forms and deadlines. Details are on the truck insurance in New Jersey page.

What to bring to the first meeting

The crash report number

If you have it. If not, tell us the road and the town and we will find the agency.

Suggested list; the firm confirms its own

Your auto insurance card or PIP claim number

Your own policy pays medical bills first for car occupants.

Suggested list; the firm confirms its own

Photos

Anything you or a family member took at the scene, of the vehicles, or of your injuries.

Nothing else is required

Do not delay the call to gather documents. The evidence clocks run from the crash date.

What this page does not say

It does not promise a result or a dollar figure. It says that the consultation is free and that the attorney fee is contingent on a recovery; case costs are addressed in the written fee agreement.
