Tractor-Trailer Crashes in Middlesex County

A tractor-trailer was involved in 29 of the 49 fatal crashes involving a large truck in Middlesex County from 2019 through 2024 (NHTSA FARS). No other truck type comes close, and it follows the freight on the Turnpike.

Fault in a semi crash is proven from records the trucking company controls. This page explains how these crashes happen on Middlesex roads, which federal and Turnpike rules apply, and which of those records disappear first. Garces, Grabler & LeBrocq, P.C. does the records work; your job is to recover.

Why the big rigs are here

Middlesex holds the busiest freight segment on the whole New Jersey Turnpike. NJDOT’s 2023 Statewide Freight Plan puts 119 million tons of freight a year, worth $182 billion, on Segment 5, from NJ 18 (Exit 9) to NJ 440 (Exit 10). North of Exit 8A the Turnpike splits into separate car and truck roadways, so most tractor-trailers in the county are concentrated on the outer lanes and on the connecting highways: I-287, US 1, US 9, US 130 and NJ 18.

The same plan placed “I-95 Middlesex/Union,” a 3.4-mile stretch, on NJDOT’s statewide list of 20 high-crash truck corridors, with 256 crashes, 134 of them involving trucks, 1 person killed and 74 injured (2019 data, NJDOT 2023 Statewide Freight Plan).

Drivers rest in the county too. NJDOT’s inventory counts 80 truck spaces at the Molly Pitcher Service Area, 50 at Joyce Kilmer, 50 at Grover Cleveland and 43 at Thomas Edison. These are the published counts; whether they are enough is a separate question that the data here does not answer.

How tractor-trailer crashes happen on Middlesex roads

Rear-end crashes, often at night. Sixteen of the 49 fatal large-truck crashes were front-to-rear, and 28 happened in the dark (2019–2024, NHTSA FARS). On December 20, 2019, a rear-end crash with a tractor-trailer on US 1 in Woodbridge, after dark, killed three people in one vehicle. On March 27, 2023, an overnight rear-end crash with a tractor-trailer in a Turnpike work zone in Edison killed one. Speed, following distance and the driver’s hours are the first things to check.

Jackknife. When the trailer swings around the tractor, it sweeps the lanes beside it. In October 2019, overnight and in rain, a tractor pulling a cargo tank jackknifed on the Turnpike in Middlesex and its driver was killed (NHTSA FARS). Brakes, load and speed for conditions are the usual causes; the firm’s jackknife page explains the mechanics.

Disabled trucks on the shoulder. On May 21, 2025, a truck driver repairing his disabled tractor-trailer on the shoulder of US 9 northbound on the Edison Bridge in Sayreville was struck and killed by a driver passing on the shoulder. That driver was charged with strict-liability vehicular homicide. A dump truck also struck two tractor-trailers stopped on the shoulder near the Grover Cleveland Service Area in Woodbridge, killing the dump truck’s driver; the public record does not give the date. New Jersey’s Move Over law requires drivers to change lanes or slow down for disabled vehicles showing hazard lights, flares or triangles (N.J.S.A. 39:4-92.2).

Distraction and red lights. On March 14, 2026, a distracted tractor-trailer driver on US 1 northbound near the Plainsboro line hit more than 50 cones, an arrow board and a parked patrol car. On April 12, 2024, a tractor-trailer carrying an oversized concrete load ran a red light at US 1 and Ridge Road in South Brunswick and struck a passenger van, killing three; the driver was charged with aggravated manslaughter and vehicular homicide. Texting and hand-held phone use are prohibited for commercial drivers, and carriers may not allow or require it (49 CFR 392.80, 392.82). See the firm’s pages on distracted driving and reckless driving.

Underride and lane-change crashes are covered on our warehouse and delivery truck page, where the Middlesex examples are concentrated.

The rules that decide fault

Hours of service (interstate)

11 hours of driving within a 14-hour window after 10 hours off; a 30-minute break after 8 hours of driving; 60 hours in 7 days or 70 in 8

49 CFR 395.3

Hours of service (New Jersey intrastate)

12 hours of driving within a 16-hour window; 70 hours in 7 days or 80 in 8

N.J.A.C. 13:60-2.1

Turnpike lane rules

Vehicles over 10,000 lb GVWR or towing a trailer may not use the far-left lane of a 3-lane section, the two far-left lanes of a 4-or-more-lane section, or any lane marked “Cars Only”

N.J.A.C. 19:9-1.9

Turnpike size and weight limits

13’6” high, 8’6” wide, 53-foot semitrailer, 80,000 lb gross

N.J.A.C. 19:9-1.9

Fatigue inference

In a vehicular homicide prosecution, proof that the driver fell asleep or had been awake more than 24 consecutive hours may give rise to an inference of reckless driving (“Maggie’s Law”)

N.J.S.A. 2C:11-5

Driver qualification

At least 21, medically qualified, one valid CDL, not disqualified; the qualification file is kept for the driver’s employment plus 3 years

49 CFR 391.11, 391.51

What’s hard to do alone

  • The electronic logs that show whether the driver was over hours only have to be kept for six months (49 CFR 395.8).
  • The post-accident alcohol test must happen within 8 hours and the drug test within 32 hours, or they are never done (49 CFR 382.303). You cannot order them; you can only make sure the results are preserved.
  • The driver qualification file lives with the carrier, often in another state, and is kept only for the employment plus 3 years (49 CFR 391.51).
  • Out-of-state carriers often try to move the case to federal court. Whether they can depends on who is named and served first (28 U.S.C. 1441(b)(2)).
  • The State Police post-crash inspection of the truck sits inside the NJSP file and has to be subpoenaed by name.

What expires, and what we do about it

  1. 8 and 32 hours

Post-accident alcohol and drug test windows close (49 CFR 382.303).

We demand the results and the carrier’s written record of any test not performed.
  2. Within days

Dashcam, engine control module and dispatch data can be overwritten in normal use.

We send a litigation-hold letter to the carrier, lessor and broker for the ELD, ECM, dashcam, inspection reports and driver file.
  3. 7 calendar days

NJDOT traffic-camera video must be requested, $100 per camera (N.J.A.C. 16:1A-4.6).

We file the NJDOT request and send OPRA and preservation letters to the Turnpike Authority.
  4. 3 months

Driver vehicle inspection reports may be discarded (49 CFR 396.11).

Covered by the preservation letter; we follow up for production.
  5. 6 months

Hours-of-service logs and supporting documents may be discarded (49 CFR 395.8).

We obtain the logs and compare them with toll, fuel and GPS records.
  6. After suit is filed

The NJSP serious or fatal crash file and the Commercial Carrier Safety Inspection Unit’s post-crash inspection require a subpoena.

We subpoena both, and check the carrier’s FMCSA crash and inspection history by USDOT number.

“When we investigate these crashes, we focus on driver logs, electronic control modules, and dashboard camera footage.”
